Terms of Service.

These Terms of Service (“Terms”) govern your use of The 239 Collective website and your participation in our events, ticket purchases and any membership program (together, the “Services”). By using the Services, you agree to these Terms. If you do not agree, please do not use the Services.
1. Eligibility
You must be at least 18 years old to use our website and request an invitation. Events where alcohol is served are limited to guests 21 and older, and valid government-issued photo ID may be required at entry.
2. Invitations and admission
The 239 Collective is an invitation-based social club. Submitting a request does not guarantee an invitation, approval or admission. We may approve, decline or revoke any invitation, guest status or membership at our sole discretion. We may refuse entry to, or remove from an event, anyone who does not follow these Terms or the instructions of our team or the venue.
3. Tickets
- Tickets are personal to the approved guest named on the order and may not be resold or transferred without our written permission.
- All ticket sales are final. Refunds are issued only if we cancel an event, unless we state otherwise in writing for a specific event.
- If an event is postponed, your ticket will be valid for the new date. If you cannot attend the new date, contact us within 7 days of the announcement to request a refund.
- Event details, including venue, schedule, hosts and programming, may change. Venues may be disclosed only to ticket holders.
- Tickets purchased through third-party platforms are also subject to that platform’s terms.
4. Membership
If we offer paid memberships, pricing, billing, benefits, renewal and cancellation terms will be presented at sign-up and form part of these Terms. Membership benefits are personal and non-transferable.
5. Conduct
We expect every guest to treat others with respect. Harassment, discrimination, unsolicited sales pitching, excessive intoxication, illegal activity, damage to property and any behavior that makes others uncomfortable are not permitted. Respect the discretion of fellow guests and do not share private conversations or images of other guests without their consent. Violations may result in removal without refund and loss of future access.
6. Photography and media
Our events may be photographed and recorded. By attending, you grant The 239 Collective permission to use photographs, video and audio that include you for promotional purposes, without compensation. If you prefer not to be photographed, please let a member of our team know at the event and we will make reasonable efforts to accommodate you.
7. Assumption of risk
Some events take place on boats, beaches, rooftops, private residences and other venues that involve inherent risks. You participate voluntarily and are responsible for your own conduct, belongings, transportation and alcohol consumption. Please drink responsibly and never drive impaired. Additional waivers may be required for certain activities.
8. Limitation of liability
To the fullest extent permitted by law, The 239 Collective, its founders, team, partners and venues are not liable for any indirect, incidental, special or consequential damages, or for any loss, injury or damage arising from your use of the Services or attendance at events, except where caused by our gross negligence or willful misconduct. Our total liability for any claim will not exceed the amount you paid us for the ticket or membership giving rise to the claim. The Services are provided “as is” without warranties of any kind.
9. Indemnification
You agree to indemnify and hold harmless The 239 Collective and its founders, team and partners from claims, damages and expenses arising from your conduct at events, your violation of these Terms or your violation of the rights of others.
10. Intellectual property
The 239 Collective name, logo, website content and design are our property and may not be used without our written permission.
11. Third-party services
We may use third-party ticketing, payment and communication providers and link to third-party websites. We are not responsible for their services, content or policies.
12. Privacy
Your use of the Services is also governed by our Privacy Policy.
13. Governing law
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any dispute will be resolved exclusively in the state or federal courts located in Lee County, Florida, and you consent to their jurisdiction.
14. Changes
We may update these Terms from time to time. The effective date above shows when they were last revised. Continued use of the Services after an update means you accept the revised Terms.
